The following General Conditions of Sale are agreed between, for one part, MECA’SYSTEM, company identified by the number R.C.S. FR 442 844 924 000 13, located at ZI Montplain, Rue JB Rozières 15100 SAINT-FLOUR, FRANCE and hereafter named "mecasystem.fr" and, for the other part, the people who wish to make a purchase via the Internet website for MECA’SYSTEM http://www.mecasystem.fr (www.mecasystem.fr), hereafter named "the Customer". These General Conditions of Sale are only intended to be for the benefit of any person who is not a business owner.

Subject These General Conditions of Sale aim to define the sales conditions between mecasystem.fr and the Customer, from the moment of the order of the services, through the payment and the delivery. They cover all the stages involved in the placing of an order and they ensure the follow-up of this order between the contracting parties.

Acceptance and conditions The Customer acknowledges having read these General Conditions of Sale at the moment that he/she places an order on the website http://www.mecasystem.fr (www.mecasystem.fr). Each time that an order is placed signifies the unconditional acceptance of these General Conditions of Sale. These General Conditions of Sale define the nature of the contractual relations between mecasystem.fr and the Customer, both parties accepting them unconditionally. These General Conditions of Sale prevail all the other conditions that may appear on any other document, except in the case of a prior explicit and written exemption. In all cases, the online provision of the banker’s card number and the final validation of the order will serve as proof of the whole order as conform to the terms of the law dated 13 March 2000. These actions will also define the amounts involved through the keying in of the Goods on the order form. The validation command has the value of the signature and the unconditional acceptance of all the operations that are carried out on the website. When you tick the box confirming that you acknowledge having read the General Conditions of Sale and that you accept them, and when you then go on to click on the validation key by using the command "CONTINUE" after the process of placing your order, you declare that you unconditionally accept all of the present General Conditions of Sale. The data recorded by mecasystem.fr constitutes the proof of the whole series of transactions carried out between mecasystem.fr and the Customer(s). The orders can be reduced or cancelled, notably according to the availability of our Goods.

Prices For each item, the price indicated in the online sales catalogue does not include the delivery costs. When the order is confirmed, the total amount on the invoice is the final price and it is expressed including all taxes and including VAT. This final price includes the price of the Goods, the charges resulting from the handling of the Goods, as well as the packing and the delivery costs. MECA’SYSTEM reserves the right to modify the sales prices that are mentioned in its online sales catalogue at any time.

Terms of payment The price must be paid when the order is placed. You can settle the invoice by a secure means using a banker’s card (Carte Bleue, Visa, Mastercard). As soon as the payment has been received, the order will be recorded. If the item is not available at that particular time, mecasystem.fr will provide a date at which the ordered item will be available or the company will offer an equivalent item. The order that has been confirmed by the Customer in this way will only be valid once the central banker’s card network has given its agreement. In the event of a refusal of payment by this organisation, mecasystem.fr reserves the right to cancel the order and to stop the delivery of the shipment. In this event, the Customer will be informed by email or telephone as soon as possible. The data concerning the banker’s card will only be kept for the period of time that is necessary to deal with the order. The amount which corresponds to the price of the Goods and the delivery costs is debited from your bank account on the day that you place your order. Your transaction is made secure by the NATIXIS PAIEMENT via SYSTEM PAY bank.

Shipment The cost of the shipment fees depends on the nature and the weight of the ordered Goods. The tariffs that are applied by the carrier will be added to the price of the ordered Goods. The customs’ levies, taxes, fees or other various taxation resulting from the import of the Goods are to be paid by the receiver on reception of the shipment. The amount of the taxes depends on the regulations that are applied in each destination country. MECA’SYSTEM cannot inform you of their exact amount. Each individual customer must therefore ensure that he/she obtains the necessary information from the local authorities that are concerned and check that the specific formalities are respected with regards to the import of goods into the territory of the destination country. Our Goods, even when sent carriage paid, are transported at the risk of the buyer. In the event of an item going missing or showing any defect, it is the responsibility of the buyer to notify the carrier and to deal directly with them.

Deliveries The delivery dates are given only as an approximate indication. A delay or the impossibility of carrying out a delivery does not entail the payment of penalties or damages in the buyer’s favour. We consider as force majeure such events that are not reasonably in our control and that can be caused notably, by the non-delivery of the Goods, a delay in the delivery, a defect that occurs during the delivery and /or all events that are laid out in the definition of the CCI 650.

Retraction The Customer has a period of 7 days (as from the date that the Goods are received) in which he/she can withdraw the order. In the event of a request for an exchange or a refund, the Customer is required to send the Goods back by registered post, as new, in the original packaging, with everything intact, accompanied by all the accessories, instructions leaflet and documents to the following address: MECA’SYSTEM - ZI Montplain - Rue JB Rozières - 15100 SAINT-FLOUR, FRANCE. All Goods that are returned incomplete will neither be taken back nor exchanged. Mecasystem.fr can, in no way, be held responsible for the loss or the damage of a consignment that is returned for an exchange. In the event that the Customer uses his/her right of retraction, mecasystem.fr accepts liability for the refund of the money that the Customer has paid, with no extra charges, but this does not include the cost of the return of the Goods. The refund is payable within a maximum period of 15 days. If the Customer returns the Goods simply because they do not satisfy him/her, mecasystem.fr will refund the cost of the Goods but the cost of the return of the Goods is to be paid by the Customer. The Customer does not have the right to retract his/her order when the nature of the Goods means that they cannot be reshipped, that they are likely to be damaged during the shipment, that the Goods are not available in stock or that the Goods have been customized. The Goods that have been manufactured especially will neither be taken back nor exchanged.

Storage and archival storage of transactions The archival storage of order slips and invoices is carried out on a reliable and sustainable support in such a way that corresponds to keeping an exact and sustainable copy in conformity with clause 1348 of the Civil Code.

Title and risk All the elements of the website mecasystem.fr, whether they are of a visual nature or in the form of sound, including the underlying technology, are protected by copyright, brands and patents. They remain the sole property of the company MECA’SYSTEM. The Customer who has a website for personal use and who wishes, for his/her personal use, to include a link on his/her website to the homepage of the website mecasystem.fr, must officially request authorization from mecasystem.fr. This case is not a matter of affiliation through an implicit agreement. On the other hand, every hypertext link which refers people to the mecasystem.fr website and which uses the technique of framing or of in-line linking is strictly forbidden. In all cases, every link, even if authorized through tacit agreement, must be removed if this is requested by the company MECA’SYSTEM.

Liability Mecasystem.fr has only an obligation of means concerning all the stages of the access to the website, the order process, the delivery and subsequent services. Mecasystem.fr will not accept liability for any of the drawbacks or damage that may be linked to the use of the Internet network. This refers notably to a break in the service, an intrusion from an external source, the presence of computing viruses or to all events that are described as force majeure, in conformity with jurisprudence. All of our Goods are used exclusively in competitions. The entire range of the Goods of MECA’SYSTEM is exclusively reserved for use off the public highway; in exhibitions, competitions, shows and trade fairs for customized cars. All the MECA’SYSTEM Goods are guaranteed against all defects in the manufacturing process. MECA’SYSTEM does not accept liability for the use and the assembly of our Goods and we strongly advise our users to request the services of a qualified professional fitter for the assembly process. The faulty Goods can, should we decide, be replaced, repaired or the cost of the Goods refunded with a credit note but we will not participate in the refund of any of the costs incurred as a result of the damage. It is forbidden to re-export our Goods outside the country for which they have been ordered, unless this clause is contrary to an article that may enter into effect.

Settlement of legal proceedings In the event that the above clause forbidding the resale of the Goods for export is not respected, we reserve the right to stop all delivery. If there is a difference in interpretation, it is the text in French which will be applied. The sales that come under these General Conditions of Sale are subject to French law. All legal proceedings that concern these General Conditions of Sale will be judged by the law court in Aurillac, Cantal, France.
